What Qualifies As a Personal Injury?

A personal injury is any serious damage to the body or mind that results from an accident or another party’s negligence. Some of the types of personal injury cases we handle are:

  • Automobile accidents: car accidents, truck accidents, SUV rollovers
  • Motorcycle accidents: head injury, broken bones, back and spine injuries
  • Work-related injuries: construction accidents, industrial accidents, injuries from defective tools, machinery or equipment
  • Wrongful death: caused by the negligence of another
  • Slip-and-Fall accidents: accidents caused by uneven flooring, loose carpet, poorly lit stairwells, or wet, icy or oily surfaces.
  • Retail store accidents: falling merchandise, injuries from hazards
  • Premises liability: property owner negligence, negligent lighting or security
  • Products liability: injuries from dangerous or defective products
  • Job site injuries: scaffolding accidents, ladder collapse, falls, electrical injuries
  • Professional negligence: accountant, realtor, architect, etc.

How Do I Know if I Have a Personal Injury Case?

An injury alone isn’t enough to establish a case. Strong personal injury cases have two important elements:

  • Liability – Someone else’s negligence, recklessness or carelessness caused your injury.
  • Damages – The injury caused real, measurable harm like medical bills, lost wages, or loss of normal life.

Herr & Low offers free personal injury consultations to help you determine whether you have a case. Contact us at (717) 397-7544 to schedule a consultation today.

How Personal Injury Claims Work

Although every case is different, personal injury claims start with filing a legal document called a “complaint.” Next, both sides conduct research to establish the facts of the case. This is known as the discovery phase, and it includes a deposition where the defense will ask you questions about the accident.

Next, there are pre-trial negotiations. At this point, the defendant may agree to pay you a settlement. If you accept it, the case is over. However, if you’re unable to settle the case, it will go to trial next. Even after a decision is reached at trial, the losing party can appeal the decision.

Is It Better to Settle or Go to Court?

Each case is unique; your lawyer will advise you on the best option for your particular situation. Many personal injury cases do end up settled out of court because this is typically a less expensive and less risky option for the defendant. However, your lawyer should fight for you to get the best outcome, even if that means going to trial.

How Long Does a Personal Injury Lawsuit Take?

A personal injury lawsuit may take a few months to several years. It depends on different factors, including whether the case ends up going to trial. Even after a trial is over, the appeals process can take years.

Personal injury law is complex and these cases can be lengthy. It’s important to hire a trusted lawyer who is familiar with personal injury law and will fight to get you the compensation you deserve.
